That the phrase “husband and wife” (or “as spouses”) on a deed has different meanings in Oregon and Washington?

 

In Oregon, it means that the spouses hold the property together, and when one dies, the other automatically succeeds without probate.

 

In Washington, it means that the property is community property, and each spouse has the right to include their half interest in his or her estate by will. (If they don’t have a will, the other spouse inherits the community property.)
